Terms & Conditions

By using Notary Hero's services, you agree to these Terms.

1. Eligibility

You must be 18+ to agree to these Terms. Minors may be notarized where legally permitted and properly authorized.

2. Services & Legal Disclaimer

We are not attorneys licensed to practice law in the United States and may not give legal advice.

3. Document Handling & Client Responsibility

Client is solely responsible for providing complete, accurate, and properly prepared documents prior to the scheduled appointment.

Notary Hero does not draft legal documents, review documents for legal sufficiency, or verify that documents meet recording, filing, title, lender, apostille, or jurisdictional requirements.

It is the Client's responsibility to ensure documents are:
  • Complete and final (no blanks unless legally permitted)
  • Accurate and ready for signing
  • Formatted correctly for notarization
  • Compliant with recipient requirements (title, court, apostille, foreign authority, etc.)

Notary Hero is not responsible for:

  • Document rejection after notarization
  • Recording refusal
  • Title company rejection
  • Apostille denial
  • Errors contained within the document text
  • Changes made to a document after notarization

If a document is incomplete, incorrect, or not ready at the time of the appointment, applicable rescheduling or no-show fees may apply.

Client acknowledges that electronic documents must be uploaded in supported formats. Notary Hero is not responsible for technical limitations or client-side upload errors.

4. SMS Terms

Notary Hero, LLC operates an SMS messaging program to communicate with customers who have explicitly opted in via our website contact form at https://notaryhero.com/contact.

Types of Messages

Messages sent through this program include appointment confirmations, appointment reminders, rescheduling updates, document signing notifications, service status updates, and customer support communications. Marketing messages (special offers, discounts, promotions) are sent only to customers who have separately opted in for marketing communications.

Cancellation / Opt-Out

You can cancel the SMS service at any time. Just text STOP to +1 202-500-7433. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery is subject to your mobile carrier's network coverage and availability.

Message & Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Supported Carriers

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

Age Restriction

You must be 18 years or older to participate in our SMS program.

Privacy

For privacy-related inquiries, please refer to our Privacy Policy at https://notaryhero.com/privacy.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.

5. Payment Responsibility & Personal Guarantee

The party scheduling or authorizing services ("Requesting Party") is financially responsible for all fees.

If payment is not collected directly from the signer, the Requesting Party remains fully liable.

This applies regardless of whether a file closes or funds.

Card-on-File Authorization

By providing payment information, you authorize Notary Hero to charge the card on file for service fees, no-show fees, rescheduling fees, and unpaid balances.

Late Payments

Balances unpaid after 60 days incur a $25 late fee. Business accounts may accrue 1.5% monthly interest (18% annually).

The Requesting Party agrees to pay collection costs, including attorney's fees.

6. Chargeback & Payment Dispute Policy

Initiating a chargeback after services are rendered constitutes a breach of these Terms.

Client agrees to first contact Notary Hero to resolve billing disputes prior to filing a chargeback.

If a chargeback is initiated for validly rendered services, Client agrees to reimburse:

  • The original service fee
  • Chargeback processing fees
  • Administrative costs
  • Collection costs and legal fees

7. Prohibited Use

  • Unlawful activity
  • False information
  • Unauthorized system access

8. International Clients

Data may be processed in the United States.

9. Limitation of Liability

To the maximum extent permitted by law, Notary Hero's total liability shall not exceed the total amount paid for the specific service giving rise to the claim.

Notary Hero shall not be liable for indirect, incidental, special, consequential, or punitive damages.

10. Dispute Resolution & Arbitration

Any dispute arising from these Terms shall first be attempted to be resolved informally.

If unresolved, disputes shall be resolved through binding arbitration in the Commonwealth of Virginia.

Each party waives the right to a jury trial.

11. Governing Law

Governed by the laws of Virginia.

12. Changes

Continued use constitutes acceptance of revisions.
